Can I use a VA loan to buy a house from a family member?

Short answer
Yes. VA allows a purchase from a family member — a parent's house, a sibling's, an in-law's — with the same appraisal and underwriting as any sale. The lender will treat it as a non-arm's-length transaction — it looks harder at the price, the appraisal and where the money is going — and a family member can sell below market and give you the difference as a gift of equity, which VA accepts as your funds. The one thing that trips people up is buying a house you already rent from the relative, which is fine but has to be documented.
VA does not prohibit sales between relatives. What changes is the lender's scrutiny, because a non-arm's-length sale is where price manipulation and undisclosed arrangements tend to hide. Expect the lender to:
- Order the VA appraisal as usual and compare the contract price to it. A price below value is fine — that is a gift of equity. A price above value triggers the escape clause like any other sale.
- Document any gift of equity with a gift letter and show it on the closing statement. Gifts from relatives are acceptable funds under Chapter 4 of the VA Lenders Handbook.
- Ask about the seller's own mortgage and confirm the payoff at closing.
- If you already live in the house as a tenant, document the lease and the payment history; a tenant buying the home they rent is common and acceptable.
