Does my spouse have to be on the VA loan?

Short answer

No. You can take a VA loan in your name alone, and the house can still be titled to both of you. Leaving a spouse off the loan is common when their credit would hurt the file, and it is allowed as long as your income qualifies on its own. In a community-property state — Texas, California, Arizona and others — the lender will still consider a non-borrowing spouse's debts, and the spouse may need to sign certain closing documents.

The VA loan is the veteran's benefit, and the only required borrower is the veteran. Everything else is a choice made file by file.

Leaving a spouse off removes their credit history from underwriting and their income from qualifying. That is a good trade when their credit is the problem and your income carries the ratios and the residual-income test on its own. It is a bad trade when you need their income to qualify.

Community-property states change one thing. In Texas, California, Arizona, Washington, Nevada, New Mexico, Idaho, Louisiana and Wisconsin, a lender must count a non-borrowing spouse's debts in the debt-to-income ratio, because those debts are legally shared — even though the spouse's credit score is not considered. Can my spouse be on the title but not the loan?
Yes. Title and the note are separate. Many couples put both names on title with one borrower on the loan.
If my spouse has bad credit, should I leave them off?
Often, if your income alone qualifies. The lender does not pull a non-borrowing spouse's credit at all outside a community-property state; inside one, a report is pulled to identify debts, but the score is not used.
